Craig W. Silverstein is a Principal of Miller, Balis & O’Neil, P.C. with a practice focusing on the representation of public power entities, particularly municipal entities, electric cooperatives, governmental subdivisions and joint action agencies in energy regulatory and transactional matters. A large majority of the client work performed by Mr. Silverstein is before the Federal Energy Regulatory Commission (FERC), both as applicant and intervening party. Areas of expertise include electric power supply, electric generation and transmission rate design and service issues, mergers, acquisitions and restructuring, hydroelectric licensing, and FERC policies and regulations. He is well versed in written advocacy, litigation and alternative dispute resolution, including successful litigation (first chair counsel) of several cases to FERC Administrative Law Judge initial decision and subsequent Commission opinion. Mr. Silverstein was recognized in 2010 and 2011 by Chambers USA as a “Leading Individual” in the Energy: Electricity (Regulatory and Litigation) Sector.
Mr. Silverstein also advises entities throughout the United States on compliance with the North American Electric Reliability Corporation (NERC) mandatory reliability standards as well as the development of FERC anti-manipulation and standards of conduct compliance programs. Work in this arena typically involves business counseling, corporate training, policy development and auditing. He has successfully negotiated favorable settlements for clients and participated in audits and other matters in five of the eight FERC designated regional reliability organization regions.
Mr. Silverstein has represented clients in energy administrative cases before state regulatory commissions in Texas, New Mexico, Colorado, Maryland and the District of Columbia, and has also appeared in a federal bankruptcy proceeding in the Southern District of Texas (Houston) and in a proceeding involving the transfer of a Presidential Permit and Export License before the U.S. Department of Energy. He also served as special energy counsel for several large ($100 M - $2 B) commercial transactions relating to the ownership, construction and operation of electric transmission and large base-load and peaking electric generating units, as well as for long-term acquisition of prepaid natural gas supplies.
Mr. Silverstein is licensed to practice law in the District of Columbia and Maryland. He is a member of the Energy Bar Association and previously served as the Chair of its FERC Administration, Administrative Practice and Administrative Law Judges Committee (2003-2004) and was a speaker at the Energy Bar Association Mid-Year Annual Meeting (2010). Mr. Silverstein is also a founding and active member of the Electric Cooperative Bar Association.
Mr. Silverstein is a graduate of American University (B.A., 1994, cum laude) and the University of Pittsburgh School of Law, (J.D., 1998). While attending law school, he was a law clerk for the Honorable Bernard Markovitz, Chief Judge of the United States Bankruptcy Court for the Western District of Pennsylvania and a law clerk for the Honorable Timothy K. Lewis, a former Circuit Judge of the United States Court of Appeals for the Third Circuit. He also worked for Miller, Balis & O'Neil, P.C. from 1993 to1995 and again, as a summer associate, in 1997.
