Electricity Regulation
Appellate Practice

Mr. Elliott is a principal in the firm. He focuses on complex electric utility regulation and related litigation before the Federal Energy Regulatory Commission, state regulatory commissions, and federal appellate courts.

Earlier in his career, Mr. Elliott was an attorney in the Office of the Solicitor at the FERC, briefing and arguing appeals of electricity, gas, and hydroelectric cases in the federal courts of appeals and briefing petitions in the Supreme Court. After graduation from law school, he served as a law clerk to Judge Thomas Penfield Jackson at the U.S. District Court for the District of Columbia.

Electricity Regulation

Since joining the firm in 1996, Mr. Elliott has counseled and represented utilities, trade associations, state agencies, financial institutions, and consumer representatives in matters involving restructured electricity markets, regional transmission organizations, transmission rates, electricity contracts, utility mergers and acquisitions, utility bankruptcies, and the regulation of public utility holding companies. He has represented clients before the FERC and federal courts in matters arising out of the California electricity crisis of 2000-2001.

Mr. Elliott has served as lead counsel in evidentiary trials and hearings at the FERC and the SEC. He also has testified in federal bankruptcy court as an expert witness on federal utility regulation.

Appellate Practice

Mr. Elliott is an experienced appellate advocate and has represented numerous clients in appeals of regulatory orders in the federal courts. He is admitted to practice before the First, Second, Fourth, Fifth, Seventh, Ninth, Tenth, and District of Columbia Circuits as well as the Supreme Court.
